1. Acceptance of terms

By accessing or using Bharosilo (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Platform. These Terms are a legally binding agreement between you and Bharosilo, governed by the laws of Nepal, including the Electronic Transactions Act 2063 (2008) and the Electronic Commerce Act 2081 (2025).

2. Eligibility

You must be at least 18 years old to create an account. If you are under 18, you may use the Platform only with the consent of a parent or guardian, as required by Nepal's Privacy Act 2075. By using Bharosilo, you represent that you have the legal capacity to enter into a binding agreement under the laws of Nepal.

3. Account registration and security

You are responsible for your account, your password, and all activity that happens under your login. Keep your information accurate and up to date. You may not use someone else's identity or account without permission. Notify us immediately if you suspect unauthorized access.

You may not create multiple accounts for abusive purposes, including evading a suspension or restriction. We reserve the right to merge or remove duplicate or fraudulent accounts.

4. User content and license

When you submit reviews, photos, replies, reports, messages, or other public content, you keep ownership of that content. You grant Bharosilo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and adapt that content so we can operate and improve the platform.

You represent and warrant that anything you submit is yours to share, does not violate anyone else's rights, and does not break any law or platform rule, including the Electronic Transactions Act 2063 and the Privacy Act 2075.

5. Prohibited uses

You may not use Bharosilo to:

Post fake, misleading, or fraudulent reviews, ratings, or content.
Engage in paid, incentivized, or quid-pro-quo reviews.
Post content that violates the Electronic Transactions Act 2063, including unauthorised access, data interference, or cyber offences under Sections 44–58.
Post defamatory, obscene, hateful, or harassing content as defined under Nepal's National Penal (Code) Act 2074.
Impersonate another person or entity.
Collect or harvest user data without consent, in violation of the Privacy Act 2075.
Engage in any activity that violates the E-Commerce Act 2081, including fake reviews, misleading advertising, or fraudulent transactions.
Use the platform for any unlawful purpose under the laws of Nepal.

6. Moderation and enforcement

We may review, edit for formatting, downrank, limit, or remove content that appears misleading, unsafe, abusive, spammy, fraudulent, or otherwise inconsistent with these terms or our guidelines. We may also restrict or suspend accounts that repeatedly break the rules.

We may use user reports, automated checks, manual review, and account history when deciding how to enforce the rules. We do not guarantee that any specific review, listing, reply, or report will remain published.

Moderation decisions are made in accordance with the Electronic Transactions Act 2063 and the E-Commerce Act 2081. Users may appeal moderation decisions through the contact page or reporting flow where available.

7. Business listings and replies

If you own or manage a business listing, you are responsible for keeping public details accurate and for making sure replies are respectful, truthful, and not coercive. You may not use owner replies to threaten, harass, or pressure reviewers into changing honest feedback.

Business owners must comply with the Consumer Protection Act 2075 when responding to reviews and representing their services. Misleading claims in owner replies may be subject to enforcement action.

8. Intellectual property

The Bharosilo name, logo, design, and platform are protected by applicable intellectual property laws in Nepal. You may not copy, modify, distribute, or reverse engineer any part of the platform without our prior written consent.

9. Disclaimer

Bharosilo is provided on an "as is" and "as available" basis. We do not guarantee that the site will always be available, error-free, complete, or accurate. Reviews and business information can change without notice, so you should use your own judgment before relying on them.

To the extent permitted by the laws of Nepal, including the Electronic Transactions Act 2063, all warranties, whether express or implied, are disclaimed.

10. Limitation of liability

To the fullest extent permitted by the laws of Nepal, Bharosilo and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from your use of or reliance on the platform. If liability cannot be excluded, it will be limited to the amount you paid to use the service, if any, to the extent permitted by law.

11. Termination

We may suspend or terminate your access to Bharosilo if you violate these terms, engage in prohibited activities, or if required by applicable law. You may delete your account at any time through your settings. Upon termination, your right to use the platform ceases immediately, but sections on content license, disclaimers, and limitation of liability survive.

12. Governing law and dispute resolution

These terms are governed by the laws of Nepal. Any dispute arising from these terms or your use of Bharosilo shall be subject to the exclusive jurisdiction of the courts in Kathmandu, Nepal. The Electronic Transactions Act 2063 and the E-Commerce Act 2081 shall apply to all electronic transactions and platform operations.

If you are a consumer, nothing in this section limits your rights under the Consumer Protection Act 2075 or any other applicable law in Nepal.

13. Changes to these terms

We may update these terms from time to time. If the changes are material, we will try to make them visible on the site. Continued use of Bharosilo after the updated terms take effect means you accept them.
